Welcome to Forage. Please read these Terms of Service ("Terms") carefully before using the Forage mobile application ("App") operated by Duo Duo, LLC ("we," "us," or "our").

By downloading, accessing, or using our App, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use our App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this eligibility requirement and have the right, authority, and capacity to agree to and abide by these Terms.

2. Account Registration and Security

2.1. To use the App, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

2.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Choose a strong password
  • Keep your account credentials secure
  • Not share your account with others
  • Notify us immediately of any unauthorized use of your account

3. Subscription and Payment Terms

3.1. The App offers premium features through subscription plans available on a monthly or annual basis.

3.2. Subscription fees will be charged to your payment method at the beginning of each subscription period.

3.3. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

3.4. If you cancel your subscription:

  • No refunds will be provided for any unused portion of the subscription
  • You will continue to have access to premium features until the end of your current billing period
  • After the billing period ends, your access to the App will be terminated

4. Acceptable Use

4.1. You agree not to:

  • Use the App for any illegal purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's operation
  • Reverse engineer, decompile, or attempt to extract the source code of the App
  • Use automated methods to access or interact with the App
  • Create multiple accounts or share your account with others
  • Submit false or misleading information
  • Use the App in any way that could damage, disable, overburden, or impair our services

4.2. We reserve the right to terminate or suspend your access to the App for violations of these Terms or for any other reason at our sole discretion.

5. Data Usage and Financial Disclaimers

5.1. Data Protection: We do not sell your personal information or financial data to third parties. Any data collected is used solely for providing and improving our services, as detailed in our Privacy Policy.

5.2. No Financial Advice:

  • The App provides informational content only and does not constitute financial advice
  • You are solely responsible for your financial decisions and actions
  • Past performance information shown in the App is not indicative of future results

5.3. User Acknowledgment: You acknowledge and agree that:

  • Any financial decisions you make are solely your responsibility
  • We are not liable for any financial losses or consequences resulting from your use of the App
  • The App's features, including reward tracking and card recommendations, are for informational purposes only

6. Third-Party Services and Links

5.1. The App may integrate with or contain links to third-party services. Your use of such services is subject to their respective terms of service and privacy policies.

5.2. We are not responsible for the content, privacy policies, or practices of any third-party services.

6. Intellectual Property Rights

6.1. The App and its original content, features, and functionality are owned by Duo Duo, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2. You may not use our trademarks, logos, or other intellectual property without our prior written consent.

7. Disclaimer of Warranties

7.1. THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

7.2. We do not warrant that:

  • The App will function uninterrupted, secure, or available at any particular time
  • Any errors or defects will be corrected
  • The App is free of viruses or other harmful components
  • The results of using the App will meet your requirements
  • The information provided through the App is accurate, reliable, or current

8. Limitation of Liability

8.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

8.2. Our total liability to you for any claim arising from or relating to these Terms or your use of the App shall not exceed the amount paid by you to us during the twelve months prior to any cause of action arising.

9. Dispute Resolution

9.1. Any dispute arising from these Terms or your use of the App will be resolved through binding arbitration conducted by the American Arbitration Association under its Commercial Arbitration Rules.

9.2. The arbitration will be conducted in California, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

9.3. You agree to resolve any dispute on an individual basis and waive any right to bring claims as a plaintiff or class member in any purported class or representative proceeding.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes through the App or via email. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

11. Inactive Accounts

We reserve the right to implement policies regarding inactive accounts in the future, including the right to terminate or suspend inactive accounts after providing reasonable notice.

12. General Provisions

12.1. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

12.2. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12.3. These Terms constitute the entire agreement between you and us regarding your use of the App.

12.4. The section titles in these Terms are for convenience only and have no legal or contractual effect.
